Please read these Terms of Service carefully before using Spain Proxy services. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing Spain Proxy's website at https://spain-proxy.com or using any of our proxy services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you must not use our services.

These Terms apply to all visitors, registered users, and paying customers. These Terms constitute a binding legal agreement between you and Spain Proxy.

2. Description of Services

Spain Proxy provides Spanish mobile proxy services, including access to 4G and 5G mobile IP addresses for the purpose of anonymous internet access, data collection, and other lawful business activities. Services are described in detail at spain-proxy.com/services.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with reasonable notice where possible.

3. Acceptable Use Policy

You may use Spain Proxy services only for lawful purposes and in accordance with these Terms. Permitted uses include:

• Web scraping and data collection for legitimate business intelligence purposes
• SEO research and monitoring
• Ad verification and market research
• Anonymous browsing and privacy protection
• Social media management for legitimate accounts
• E-commerce price monitoring and competitive analysis
• Security research (with authorisation from target systems)

4. Prohibited Uses

You must not use Spain Proxy services for any of the following:

• Any illegal activity under applicable law, including Spanish law and EU regulations
• Distributing malware, viruses, or other harmful software
• Conducting distributed denial-of-service (DDoS) attacks
• Sending unsolicited commercial email (spam)
• Accessing systems or data without authorisation
• Copyright infringement, piracy, or illegal content distribution
• Identity theft, fraud, or phishing
• Circumventing legal geographic restrictions for unauthorised streaming
• Any activity that violates the rights of third parties

Violation of these prohibitions may result in immediate termination of your account without refund and may be reported to law enforcement authorities.

5. Accounts & Access

You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. You must immediately notify Spain Proxy of any unauthorised use of your account. Spain Proxy cannot be held liable for losses resulting from unauthorised account use where you have not notified us promptly.

6. Payment & Billing

Payment for services is due in advance of the service period. All prices are in Euros (EUR) and exclude applicable taxes unless stated. Subscription fees are non-refundable except where required by applicable consumer protection law or where Spain Proxy fails to deliver the agreed service level.

Spain Proxy reserves the right to change pricing with 30 days' notice to existing subscribers.

7. Service Level Agreement (SLA)

Spain Proxy targets 99.9% monthly uptime for its proxy infrastructure. Scheduled maintenance windows will be communicated in advance. In the event of service unavailability exceeding 0.1% in a calendar month, customers may request a service credit proportional to the downtime, subject to verification. This SLA does not apply to outages caused by force majeure events, customer misuse, or third-party network issues.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Spain Proxy's total liability for any claims arising from these Terms or the use of our services shall not exceed the amount paid by you for services in the three months preceding the claim.

Spain Proxy is not liable for: indirect, incidental, or consequential damages; loss of data; loss of revenue or profits; or damages resulting from your misuse of the service or violation of applicable law.

Our services are provided "as is" and "as available." We make no warranties regarding uninterrupted access, specific results from using our proxies, or fitness for a particular purpose beyond what is explicitly stated.

9. Intellectual Property

All content on the Spain Proxy website, including text, images, logos, and software, is the intellectual property of Spain Proxy or its licensors, protected by Spanish and international copyright law. You may not reproduce, distribute, or create derivative works without written permission.

10. Termination

You may terminate your subscription at any time by contacting us. Spain Proxy may terminate your access immediately and without notice for violation of these Terms, particularly the Prohibited Uses in Section 4. Upon termination, your right to use the service ceases immediately. Account data may be retained as required for legal compliance per our Privacy Policy.

11. Governing Law & Disputes

These Terms are governed by the laws of Spain and applicable EU law. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Spain. For consumers in the EU, you may also have access to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr/.

12. Changes to These Terms

We may update these Terms periodically. Material changes will be communicated via email (where you have provided one) or a prominent website notice at least 14 days before the changes take effect. Continued use of our services after changes constitutes acceptance of the updated Terms.
